NDAA and BlueUAS Compliance Statement

The Ewing Aerospace EwingVTX is designed, manufactured, and supplied in compliance with applicable provisions of the National Defense Authorization Act (NDAA), including Section 889 of the FY2019 NDAA, as amended and carried forward in subsequent NDAA authorizations. Furthermore these products comply with NDAA FY2023 Section 817 and the 2024 American Security Drone Act.


Section 889 (a)(1)(A) & (B) Compliance

Ewing Aerospace certifies that the EwingVTX:

  • Does not contain covered telecommunications equipment or services as defined in Section 889(a)(1)(A) of the NDAA.
  • Is not produced using covered telecommunications equipment or services as defined in Section 889(a)(1)(B) of the NDAA.
  • Does not include components, modules, firmware, or embedded services from prohibited entities, including but not limited to:
    • Huawei Technologies Company
    • ZTE Corporation
    • Hytera Communications Corporation
    • Hangzhou Hikvision Digital Technology Company
    • Dahua Technology Company
    • Any subsidiaries or affiliates of the foregoing.

Supply Chain and Manufacturing Controls

  • Designed in the United States – designs and RF architecture are owned and controlled by Ewing Aerospace.
  • Final assembly, programming, testing, and quality acceptance performed in our Ashland, Ohio facilities.
  • Maintains supplier vetting and component traceability controls to ensure ongoing NDAA compliance.
  • No restricted-origin RF, communications, or networking silicon is used in the EwingVTX platform.

Software and Firmware

  • Firmware does not incorporate proprietary cloud services, telemetry backhauls, or remote access mechanisms from prohibited entities.
  • Operation and configuration do not require connectivity to non-compliant infrastructure.
  • All configuration interfaces are locally controlled and integrator-managed.

Applicability to UAS Programs

The EwingVTX is suitable for integration into NDAA-compliant UAS platforms, including:

  • U.S. Government and DoD programs
  • Federal, state, and local agency procurements
  • Defense contractors and system integrators
  • Enterprise and critical-infrastructure unmanned systems

Ongoing Compliance

Ewing Aerospace actively monitors NDAA updates and applicable FAR/DFARS requirements and will take appropriate action to maintain compliance should statutory or regulatory requirements change.

Always follow applicable regulations, RF emission limits, airspace rules, and program-specific safety requirements.


FCC Compliance and Regulatory Notice

The Ewing Aerospace EwingVTX is an RF transmitting device intended for integration by qualified professionals into unmanned systems and other authorized platforms.

FCC Compliance Status

This device is not marketed as a consumer end product and is intended for professional, industrial, and government system integration. As such:

  • The EwingVTX may require integrator evaluation, testing, and authorization under applicable FCC rules, including but not limited to 47 CFR Part 15 and/or Part 97, depending on configuration, operating frequency, output power, and end use.
  • Final FCC compliance responsibility rests with the system integrator or operator, including ensuring proper authorization, labeling, and operation within permitted frequency bands and power limits.
